The Central Staffing Scheme read with letter No. 15/49/2009-CSI(D) dated the 10th April, 2010 addressed to me, provides for promotional avenues to the meritorious officers of the Central Secretariat Service (CSS), for appointment at the level of Director and above. Prior to the year 2003, i.e., prior to the cadre review of the CSS there was no restriction on the number of officers of the level of Deputy Secretaries, whose services could be recognized as meritorious. Accordingly, this had been done in the year 2006 (belatedly) in the cases of Deputy Secretaries of 1995 and 1996 Select Lists with five years approved service, who became eligible for consideration for inclusion in the suitability lists of Director for promotion in recognition of their meritorious service, during the years of 2000 and 2001 respectively. With approval of the Prime Minister it was decided to include 19 and 11 officers retrospectively in the two suitability lists of Directors. In other words their services were recognized as meritorious retrospectively with the approval of the PRIME MINISTER. As such they were required to be promoted from those years. Unfortunately, the DOPT promoted them prospectively from the year 2006 only in violation of the decision taken with the approval of the Prime Minister. It is also a fact that there are no rule/instructions for such recognition prospectively.

The affected senior officers filed an SLP in the Supreme Court of India. The SC admitted the same and have issued notice in the matter.
