View Full Version : Encashment of leave at credit at the time of superannuation

Dear Friends,

I availed LTC during the block year 1998-99 and encashed 10 days of earned leave while availing that LTC. From then, accumulation of my EL was limited to 290 days in stead of 300 days as maintained for other employees.

I will be retiring 0n 30-06-2012 on superannuation and I have 285 days of EL and 35 days of HPL at my credit. My office says that I am eligible for encashment of 285 days of EL and 5 days of HPL only, as I already availed encashment of 10 days EL in 1998. But, I assume that I am eligible for encashment of 285 days of EL and 15 days of HPL as per the existing rules .

Senior members may kindly give their opinion on the above.

CCS(Leave) Rules, 1972 have been modified consequent to implementation of 6CPC, vide Notification dated 1/12/2009 (http://circulars.nic.in/WriteReadData/CircularPortal/D2/D02est/11012_1_2009-Estt.(L).pdf).

The total encashment of EL+HPL permissible on retirement is now 300 days. Accordingly, you will be eligible for encashment of 285 days of EL and 15 days of HPL on superannuation.

Also the restriction of accumulation of EL to 290 days instead of 300+15 days is not in order, even before the issue of the present modification.

My office still says that the earlier order for encashment in 5 th pay commission is that the number of days encashed will be deducted from the maximum of 300 days. where as in the sixth pay commission the encashment of EL for LTC (maximum 60 days) will not be deducted from the maximum of 300 days if the official is having maximum 300 days. And these revised orders for encashment of 60 days is effect from 1-9-2008 and past cases will be not be considered.

Kindly refer to the modified Rule 39(2)(a) which prescribes the new formula for calculation of leave encashment. There is no provision in this formula for taking into account previous cases or to specify two different classes of employees for leave encashment purpose. As you have retired on 30.6.2012, the revised formula is applicable in your case.
