The expected clarification regarding CCL has come. Any idea about when will the modfied acp orders issued? Our friend jitendar has correctly predicted the clarification regarding CCL. He has also stated that the orders on modified acp will be issued on 15th November. Any update?

no update available. It may come on any day. It may be better if it comes late then definitely some good can be expected. Keep your fingers crossed. May god give some good thoughts to Mof people involve in formulation of new ACP scheme. This time I want to be proved wrong.

Dear friends,
It is a pity that Modified ACP OM is yet to be issued, especially when we have had the experience of getting benefits only prospectively, we must pray for early issuace of the OM on the subject.

It is true there is a delibrate delay in the issuance of the ACP OM. It appears some clarification is issued regarding the fixation in case of UPGRADATION and I wish someone in the discussion board to through more light on that. As we know, they have not ensured the minimum of the upgradation scale while fixing and only grade pay was changed. Same was the case with merger of scales also.

Mr.BMji we should also pray for improvement of global financial scene and in India in particular so that govt has revenue to fianance the pay bill of its employees. Revenue estimates have taken a severe beating, as we know.

We must thank God, govt. implemented the 6cpc report before the present scenerio, else they would have kept everything on hold.

I also keep same optimisam as Mr.Jitendra said. However, I am afraid that how our counterparts in the Implimentation Section can carve out a beneficial modified scheme from the existing scheme and accepted recommendations.

I would like to explain my case:

While working as Inspector in the pre-revised scale of Rs.6500-10500 I got my Ist ACP to 7500-12500 from 9.2.2008. In the absence of any proper order, as per the revised fixation order based on 6CPC, my Grade was Rs.4200 w.e.f. 1.1.2006 and Rs.4800 w.e.f. 9.2.2008 (on ACP). I got the upgradation after 12 years on the basis of the existing scheme. In the light of the new accepted recommendations of ACP, my G.P. likely to be fixed as below:

1.Rs.4600 w.e.f. 9.2.2006 and Rs.4800 from 9.2.2016(if no promotion) - ie. I am likely to be in a disadvantage position.

2.Rs.4800 w.e.f. 9.2.2008 (if 10 yr condition is not applied retrospectively) by foregoing all the arrears upto 8.8.2008 - ie. in this case also disadvantage position.

3.In the case of 2. above I will get my 2nd ACP on 9.2.2018 to 5400 in PB-2 and on 9.2.2028 on 3rd ACP my shall be 6600. But GP 6600 in not available in PB-2 only option is to jump to PB-3.
(item 3 is only to say that it will be difficult to formulate a modified ACP in present Grade Pay, Pay Band and the ACP recomendations.

Yes, I agree with Sudarshanajee.

I pray to God to bless our country to come out of the "after effects" of the global recession.
At the outset, if things do not improve, next year arrears will not be possible.
Every GS should try his/her level best to contrive govt money.

This reply is addressed to Shri Narayanan.
Shree Narayanan can rest assured that his Second ACP will become due on 09.02.2016, because the Govt has accepted that at the end of 10 years, 20 years and 30 years, the GS (who ever has not got promotion through the normal route) would get ACP.
Even if the Govt does not reopen the past cases as regards of date from which ACP should be given, as and when the ACP OM is issued, all who had crossed 10 years , 20 yrs and 30 yrs as on the cut off date may have to be given the 1st, 2nd and 3 rd ACP respectively, at the worst case, the Govt may choose to given prospective date ( no arrears), but it is un likely unlike last time. Because, last time, the scheme was new and govt and departments took one plea or another in giving effect only prospectivelyfrom 1999.
Coming to the case of Narayanan, I am pretty sure that he will get his second ACP on completion of 20 years service in 2016 February and he shall not wait till 2008.
As for the Grade pay problem, if the feeder cadre of Tech Asst or Sr Tech Asst is maintained (this they have to, in my view), then because of merger of 5000, 5500 and 6500, the cadre of inspector with 6500 pre rev scale has to be upgraded to 7450 (with grade pay of 4600) as on 1.1.2006. Therefore, Shree Narayanan will get 4600 Grade pay from 01.01.2006 and on 1st ACP would go to 4800 (even if no arrears are paid for the period between 9.2.2006 to the date on which Revised ACP comes into Force) prospectively from 9.2.2008 (the date on which he was actually granted), by the way has he given the option to have his ACP from 1.7.2008 (the way my brother has done in Trichy Commissisonerate? (In my personal view, Shree Narayanan would go to 4800 GRade pay w.e.f 9.2.2006 (the date on which he started his eleventh year of service as Inspector.

As you explained I hope that the GP of Inspector will be upgraded to Rs.4800 and the ACP upgradation will be granted w.e.f.9.2.2006.

by the way has he given the option to have his ACP from 1.7.2008 (the way my brother has done in Trichy Commissisonerate? (In my personal view, Shree Narayanan would go to 4800 GRade pay w.e.f 9.2.2006 (the date on which he started his eleventh year of service as Inspector.

Dear Shri Badriji, my case is similar to Shri.Narayanan. I complete 10 yrs in 25.03.06. will i get my 1st ACP on 01.07.06? In my dept., they have not yet issued any orders on ACP till date for me[only me], neither old version nor new one!they are waiting for instructions! BTW what is the implication in giving option for ACP from 1.7.08? kindly illuminate-raj.

In my view your department has not done any thing wrong. Since no ACP orders issued till date, there is no benefit to grant ACP benefit at this stage in accordance with old ACP scheme. It is better to wait for ACP orders for clear pictures. We are also waiting for the same No need to worry. Whatever will come will give us some benefit may be less then expected.

Jitenderjee ( "Jjee" as addressed to by me often in this forum) has the liberty. He is welcome to say his view. It is a great thing that we have in our midst stars like Sudarshanajee, ("ssjee", for short), Sundararjee ("sdrjee" for short).

Coming to the subject, Jjee may kindly take notice that our Board, CBEC has released ACP order No.7/2008 dated 30.9.2008 whereby it has granted 2 nd ACP (in accordance with the existing(yes, till date) system of 12 and 24 years stipulation! The latest date covered (completion of 24 years as per the list is 28.9.2008.

I remember a post in this forum by my learned collegue, Shri Coolgoose 2jee, wherein the learned friend was wondered as to whether Modified ACP has been buried!?

the officer at Sl. No.255of the said order is granted 2nd ACP in the pre-revised scale 8000-13500 (belonging to the post of Asst. Commissioner and which was revised to 5400 GP in PB3) on 19-09-2008. Now the said officer, in most likelihood, might have opted for SPC as on 01-01-2006 or thereabouts. So he is most likely to be in 4800 GP in PB2.

So if this person is granted a pre-revised scale of 8000-13500 on 19-09-2008, what is the net result for the officer ?

whether the officer's pay would be continued to be fixed as per pre-revised scale as on 31-12-2005 till 19-09-2008 and then granted 8000-13500 scale and then given fixation as per SPC (5400 GP in PB3) ?

If so, what happens to the arrears, that might have granted to him?

How it is possible to continue fixation in pre-revised scales after date of notification of SPC ?

Dear CG2jee,
In my view, after 29.08.2008, unless the concerned individual has opted to be retained in the Pre Rev scale (as on 31.12.2005) the Department can not fix the pay of the individual in the Pre rev scale. At best, the Office Order under study can be interpreted as an order of granting ACP under CCS(R.P)Rules 2008.
Withdrawing an order or issuring Corrigendum to Office Order is nothing new to our department.(No offence intended).
Officers concerned may at best get an increase in Pay (Existing Pay(CCS Revised Rules)2008 plus existing Grade pay of 4800) and will get Grade pay of 5400.
