As per LTC Rules

a) when advance is taken the claim should be submitted within 1 month from the date of return journey. If not outstanding advance will be recovered in one lumpsum and the claim will be treated as one where no advance is sanctioned.
b) When no advance is taken, claim should be submitted within three month from the completion of return journey, otherwise the claim will be forfeited.

An official has taken LTC advance but submitted the bill only after 2 months of completion of return journey. He was directed to refund the advance with penal interest since he has not preferred the claim within one month.

After refund of the advance, whether his claim can be settled treating as no advance has been sanctioned and also he has preferred the bill within 3 months of completion of return journey.

Yes.
Advance has to be recovered with penal interest @ 2 percentage points above prevalent rate of interest on GPF, calculated from the date of drawal to the date of recovery.

Since the claim is preferred within the stipulated period where no advance is sanctioned, the claim is to be processed normally.
