View Full Version : Anomaly case due to Promotion before& after 1st Jan 2006

Sir, I am a Govt. servant working in DAE, I need your valuable guidance for applying Pay anomaly , and here with compare my case with Mr. X
My case: As on 1st Jan.2006 my basic pay was 7100 in the Pay scale of 6500-200-10500.
I was promoted to that pay scale with effect from May 2005. After implementing VI CPC that is as on 1st Jan 2006 my basic was fixed to 13210 with Grade pay of 4600.
And As on 1st July 2006,Basic 13750 GP 4600
As on 1st July 2007,Basic 14300 GP 4600


Mr.X case:
Where as my Junior in terms of Grade (but he is senior in terms of date of joint in Govt. Service) Basic pay as on 1st Jan 2006 was 7075 in the Pay scale of 5500-175-9000. After implementing VI CPC that is as on 1st Jan 2006 his basic was fixed in 13160 with Grade Pay of 4200.
And As on 1st July 2006,Basic 13680 GP 4200
He got promotion on 1st Nov.2006, so he fixed to Basic 14220 GP 4600
As on 1st July 2007, Basic 14790 GP 4600
As it is evident from the above detail Mr X, who promoted 1 year after me is drawing a Basic Pay of Rs 490/- more than me in this condition. I have lost my promotion seniority and less pay also. Under the above circumstances shall I apply for Pay Anomaly?
Under what Rule I may apply pl. Reply me in detail.

You are entitled to stepping up of pay to Rs. 14220 w.e.f 1st Nov 2006 in terms of Note 10 below Rule 7 of CCS(RP Rules, 2008 subject to fullfilment of conditions indicated therein.

I have applied for pay Anomaly my case with junior(as said in my 23/12/'11 dted. post), the Accounts section rejected my case and I here with sending thier letter content as it is.

"In terms of note 10 below Rule 7 CCS(RP) Rules 2008, there is no pay anomaly, in respect of you.

This issues with the approved of the Competent Authority."

As indicated in my earlier post the stepping up of pay is admissible in terms of Note 10 below Rule 7 of CCS(RP Rules, 2008 subject to fullfilment of conditions indicated therein.

I feel you may not be fulfilling the third condition i.e. the senior at the time of promotion should have been drawing equal or more pay than the junior. This implies that at the time of your promotion in May 2005 you should be drawing equal or more pay than your junior. This also implies that the "junior" in this case was also junior to you in the lower grade (scale: 5500-9000).

Kindly compare the factual position as on May 2005. If the "junior" at present was earlier senior to you in the lower grade but could not be promoted due to some reason or the junior was drawing more pay than you in the scale of 5500-9000 than there is no scope for stepping up.
