Please clarify whether central government offices can declare leave on account of local body polls in Tamilnadu on 17th and 19th october based on the orders of the Tamilnadu government. As per the existing GOI instructions issued in 2001 and available in Swamy Establishment and Administration book under the chapter LEAVE , central government employees can be granted permission to cast their vote in the local body polls. Has any central government offices have declared leave on 17th october.

u yrself had got clarification...........how do u expect 'any central government offices have declared leave on 17th october'? Leave will be declared ONLY for LOKSABHA/ASSEMBLY elections.

Thanks a lot victor sir, actually there is lot of misunderstanding and confusing in many central govt offices / autonomous bodies, some have declared holiday, whereas many have given only permission we have also given only permission to employees. .. after consulting other central govt employees, DOPT order and local central govt employee welfare coordination committee..

OFFICE MEMORNDUM

Sub : Closing of Central Government Offices in connection with elections to Lok Sabha / State Assembly / Panchayat / Municipalities / Corporation or other Local Bodies -regarding

In modification of these instructions contained in this Departmentís OM No.12/4/86-JCA dated 9th March, 1987, the undersigned is directed to say that the following guidelines are prescribed for future for closing of Central Government Offices including industrial establishments in connection with the elections indicated above.

(i) The relevant organizations shall remain closed in the notified areas where general elections to Lok Sabha or State Legislative Assembly are scheduled to be conducted.

(ii) In connection with bye-election to Lok Sabha / State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling Special Casual leave may also be granted to an employee who is ordinarily a resident of a constituency and registered as a voter but employed in any Central Government Organization / Industrial Establishment locate outside the constituency having a general / bye-election.

(iii) In connection with local body elections, viz., Panchayat/Corporation / Municipality, the Government employees who are bona-fide voters and desire to exercise their franchise should be offered reasonable facility, subject to normal exigencies of services, either by coming late to office or being allowed to leave office early or a short absence on that day.

2. The employees detailed on election duty may also be permitted to remain away from their normal duties on polling day (s) as also on the days required for performing journeys which might be undertaken in order to perform such election duty.

The above instructions may be brought to the notice of all concerned.

Clarification regarding joining time
sir,
One of my collogue work as PRT in Kendriya Vidyalaya & promoted as
TGT(BIO) through limited department Examination on . She posted from
another place from present posting place (present posting place was
Sawai Madhopur & Posted to Kendriya Vidyalaya Karauli (RAJASTHAN) .At
the time of promotion she was on maternity leave up t 21.12.2010, she
applied for extension of joining time due to maternity leave but
inspite of them DDO relieved her in absencia on 25.10.2010 .She
resumed her duties on 22.12.2010 after expiry of maternity leave . She
shifts her family on 15.01.2011. She applied to credit unavailable
joining time of 10 days to her service book but KVS authorities denied
to credit them to say that she has relieved on 25.10.2010 so your
joining time cover in the maternity leave, please clarify me that in
such condition what is the rule position.

Kindly refer to CCS(Joining Time) Rules, 1979. As per Rule 5(1) of these rules, "joining time shall commence from the date of relinquishment of charge of the old post". This implies that the officer in case he is on leave can proceed on transfer only after he joins his old post and hands over charge.

If an officer is on leave than the admin has two options. Either allow the officer to avail the sanctioned leave and relieve him after he joins back from leave OR recall the officer to duty before the expiry of leave under Rule 23 of CCS(Leave) Rules, 1972 and then relieve him on joining duty.

Further, a person on leave is entitled to leave salary (Rule 43(2) of CCS(Leave) Rules, 1972) while a person on joining time will be treated as on duty and entitled to joining time pay (Rule 7 of CCS(JT) Rules, 1979). This implies that a person cannot be on leave and joining time concurrently since he can either draw leave salary or joining time pay.
