View Full Version : Paternity Leave & Medical Certificate

This post has three parts (separate from each other) :


a) A person avails paternity leave for his first child. Divorces his wife. Remarries. Avails paternity leave for his second child ( but first for his second wife).
On the arrival of a second child for the second wife (i.e. third child for him), can he apply for paternity leave? (My opinion is NO).

b) A person not covered by CGHS remains absent for 3 weeks. On rejoining he produces a certificate from a Hoemopathic doctor. Is it valid? Can he be granted commuted leave? (My opinion is YES).

c) Also, if a person is on half-pay leave covering entire month, will he get Tpt allc?(My opinion is NO).

(a) Paternity Leave is admissible for maximum two surviving children borne by the sum total of all wives.

(b) A Govt. Servant not conved under CGHS has to produce a MC from an Authorized Medical Attendant. In case of hospitalization or indoor specialized treatment than the MC is required form an Authorised Doctor of a private hospital recognized under Centra Services (Medical Attendance) Rules, 1944.

(c) If Leave of any kind if availed for a full calendar month then Transport Allowance for that month is not admissible.

Dear Mr. Rao
1. A CG employee is entitled to avail paternity leave for 2 children only and hence, for the 3rd child, whether it is from the existing or legally separated wife, he is not eligible for this benefit for the 3rd time.

2. If medical and fitness certificates of a registered doctor/hospital is produced commuted leave shall be sanctioned

3. If a person is absent from duty on any kind of leave for a month, he is not eligible of transport allowance.
