View Full Version : Request for clarification to grant me Grade pay of Rs.4600/-

Respected sir,
Good after noon Sir, I would like to share my problem and requested to you give me your valuable suggestion to find the solution.
I have been appointed as LDC in the pay scale of Rs.260-400 through Staff Selection Commission Clerk Grade Examination in Sep.1984 in Bank Note Press, Dewas ( a Unit of Ministry of Finance). In 1991 have been promoted to the post of UDC on regular basis in the pay scale of Rs.4000-6000. In 2002 one vacancy of Junior Hindi Translator has arisen which was filled through on transferred/ absorption basis. Application were called from LDC having 8 yrs. regular basis and UDC with 5 yrs. regular service. I have also apply for the post of Jr.H.T. In a Limited Departmental Competitive Departmental Test , I have been selected and appointed to the post of Junior Hindi Translator w.e.f. 1.1.2003 in the pay scale of Rs.4500-7000. On 1.1.2006 my basic pay was Rs.5500/- .
In accordance with the recommendation of Six Pay Commission , the Govt. vide OM No.1/1/ 2008-IC dated 24.11.2008 and 27-11-2008 has upgraded the pre-revised pay scale of Junior Hindi Translator to Rs.6500-10500 the link is as under http://finmin.nic.in/6cpc/fno112008dt271108.pdf . In compliance of the above OM , my department has fixed my pay as under :-
-- On 1.1.2006 Old Basic Pay Rs.5500/- Pay scale Rs.4500-7000 (Pre-revised)
-- Upgraded Pay scale of Jr.H.T. as on 1.1.2006 is Rs.6500-10500 (Pre-revised)
-- As on 1.1.2006 basic pay is Rs.6500/- (Minimum basic pay of Pre-revised Pay
scale) x 1.86 = 12090/- + 4200/- Grade pay.

Mean time the Govt. vide OM No.1/1/2008-IC dated 13.11.2009 pre-revised scale of Rs.6500-10500 as on 1,1,2006 which were in the normal replacement pay structure of Grade pay of Rs.4200/- in the PB-2, will be granted grade pay of Rs.4600/- in the pay band PB-2 corresponding to the pre- revised scale of Rs.7450- 11500 w.e.f. 1.1.2006. the link of the OM is as under http:// finmin.nic.in/ 6cpc/ om dated 131109_4600gradepay.pdf .

In view of above OM , my pay should be fixed as under :
-- On 1.1.2006 Replace Pay scale of 6500-10500 is Rs.7450-11500
-- As on 1.1.2006 Basic pay Rs.7450/- (Minimum of 7450-11500) X
1.86 = 13857/- + 4600/- Grade pay.

I have requested to My department to implement the above OM and fix my
pay , I have send three reminders also but my department has not give any
reply to me till date.

In view of the circumstances explained above It is requested to guide me
on following points :
1. Whether fixation done by my department in the Pay Scale of Rs.6500-10500
is right ?
2. Whether in accordance with OM No.1/1/2008-IC dated 13-11-2009 on
1.1.2006 my basic pay is to be fixed Rs.7450/- instead of Rs.6500/- in the
pre-revised scale and fixation of pay in 7450/- x 1-86 = Rs.13857/-
with Grade pay Rs. 4600/- is right ?
3. In situation of non compliance of OM by my department What is step should
be taken ?

First your office to upgrade 6500 with 7450 and then only pay fixation be done

The fixation of your pay at Rs. 6500 in the pre-revised scale of 6500-10500 as on 1.1.2006 is itself wrong. Kindly refer to OM dated 13.10.2008 (http://finmin.nic.in/6cpc/fno112008dt131008.pdf) which indicates the methodology to be adopted in cases of upgradation of pay scale on the recommendations of 6CPC. As per this OM your pay should have been fixed w.r.t. the basic pay of Rs. 5500 in the fitment table of pre-revised scale of 4500-7000, to which GP 4200 will be added.

As regards, OM dated 13.11.2009 (http://finmin.nic.in/6cpc/omdated131109_4600gradepay.pdf) it may kindly be noted that only those posts "that existed in the pre-revised scale of Rs. 6500-10500 as on 1.1.2006" would be granted GP 4600. Since your post never "existed" in the pre-revised scale of Rs. 6500-10500 as on 1.1.2006 you are not entitled to GP 4600. In any case there is already a post of Sr. Translator which carries GP 4600 (http://finmin.nic.in/6cpc/fno112008dt271108.pdf). The posts of Junior and Senior Translator have not been merged so far by the Government.

As per the following feed back of 3rd NAC Meeting held on 15.2.2011 by AIRF, soon some order can be expected.

"Item No.50: Anomalies in the pay scales of official language staff - Since the issue of Rajbhasha Staff has been sent to Ministry of Finance(Exp.) Official Side agreed to send its approval at an earliest".

As per the following feed back of 3rd NAC Meeting held on 15.2.2011 by AIRF, soon some order can be expected.

"Item No.50: Anomalies in the pay scales of official language staff - Since the issue of Rajbhasha Staff has been sent to Ministry of Finance(Exp.) Official Side agreed to send its approval at an earliest".
