View Full Version : Inter Se seniority in Direct recruitment

Dear Sir,

I would like to draw your kind attention on following recruitment case.

1. Ministry XYZ has advertised three posts of Technical Assistant (Two for Electronics (01 UR & 01 OBC), One for Radio & TV, reserved for Supreme Court) in the pay scale of Rs. 9300-34800, GP 4200/ in Employment News.

2. A written Test followed by practical test and interview was conducted by a common selection Committee. Three Candidates A (UR) B (Supreme Court) & C (OBC) were selected by the selection Committee.

3. The candidates have joined the posts one by one on different dates i.e. in order of B (Supreme Court) C (OBC) and A (UR).

4. A (UR) has joined his duty with delay as he was already in Govt. Job at different organization.; as A has to give three months notice to his parent department before getting relived. Ministry XYZ has also granted the permission for extension of joining time to A.

5. Ministry XYZ has declared the inter se seniority of all three Technical Assistants as per their joining date. (i.e. in order of B (Supreme Court), C (OBC), and A (UR)).

6. A (UR) has given a representation to Ministry XYZ regarding inter se seniority of new recruited Technical Assistants stating that seniority is determined only on the basis of merit not as per joining date.

7. In reply of above representation Ministry XYZ has given interpretation that since all the three posts are belong to different category (UR/OBC/Supreme Court) and selection committee has prepared three separate merit lists for three categories. Hence the inter se seniority would be as per joining date.

In the view of above case, it is requested to kindly suggest the following points

In the above case what should be the inter se seniority among all three candidates.
What should be the criteria for determining their Inter se seniority? As the Selection Committee has prepared three separate merit lists for three categories.
the decision taken by ministry XYZ regarding Inter se seniority is right

The decision taken by the ministry is not correct. There should be combined seniority list based on the merit

Kindly refer to para 2.1 on 'Instructions and Guidelines on Seniority' available at (http://persmin.gov.in/DOPT/Seniority_Instructions_Guidelines/Seniority_Instructions_Guidelines.pdf).

The relative seniority of all direct recruits is determined by the order of merit in which they are selected for such appointment and not as per the date of joining.

If the written test, practical test and interview were common for all the candidates (irrespective of discipline), then the seniority list will be as per the order of merit.
