View Full Version : how to accommodate an incumbant in a non-existing vacancy?

1. In an Office following are the Sanctioned staff under Group C posts viz. UDC (02) and LDC (04). One UDC ( Mr. X) is elevated to Group B post on deputation basis in the same office and senior most LDC (Mr. Y) is given adhoc promotion to the vacant post of UDC and subsequently the vacant post of LDC is filled up on deputation basis from another Office (Mr. Z).

2. One fine Afternoon (20.10.2010) the Office reverts Mr. X to the post of UDC and Mr. Y to the post of LDC, but no reversion / repartriation of Mr. Z.

3. The stand of the Office is that since one LDC is being offered a promotion to the post of UDC in the Forenoon of 21.10.2010, there is no need for repartriation of Mr. Z to his Parent Department in the Afternoon of 20.10.2010.

4. Please enlighten with applicable Rules.

But, Mr. Pathak, how can there be two LDCs against one vacancy, even if it is for a single day?

It appears that there is also a vacant post of UDC against which the LDC is to be promoted on 21/10/2010. Hence the LDC on deputation can be temporarily reckoned against this vacancy.

If the LDC has to be repatriated then the whole excercise of filling up the vacancy has to be done again. Your office has taken action to avoid unnecessary expenditure and extra work which is in the public interest.

Sorry for the delay. I would request a further clarification: "If the offer of promotion to the post of UDC is given to one of the
permanent LDC (not Mr. Y) on 20.10.2010 (A/N) to ASSUME CHARGE LATEST
BY 24.10.2010, in that situation, whether Mr. Z can be allowed to
continue in the strength of the office as on 20.10.2010(A/N)"

The reply given earlier still stands. If there is a vacant post of UDC, then Mr. Z can be temporarily reckoned against this vacancy to avoid unnecessary public expenditure involved in repatriation and then again going for recruitment of a candidate on deputation.

Your office has not crossed the limit of overall strength of the organisation as such there is no problem to accommodate a junior against the senior vacancy
