Default Pay Fixation Anomalies Due to Promotion 6500-200-10500

I have joined ADRIN, Department of Space on 27.07.2001 as Technical Assistant 'B' in Scale - 5000-150-8000. On 01.10.2004 I was promoted to Technical Assistant' C' and my scale became 5500-175-9000. In February 2006, there were scale upgradation in Department of Space, due to which our scale was upgraded to 6500-200-10500 from 01.04.2006 and my basic pay was fixed on Rs 6500/-. After 6th pay Commission, my basic was fixed as (6500*1.86+4600).per son who joined in september 2007 in same scale (6500-200-10500)is given basic pay ( 13350+4800). So at any given time his basic pay is much higher than me.
I want to know whether I am also entitled for the same basic drawn by him.

If any other employee who has joined ISRO in 6500-200-10500 grade, after 1.4.2006 will be drawing much higher basic as on 1.4.2006 my basic pay is fixed at 12090+4600 and newly recruited employee will be getting 13350+4800.

Can anybody suggest me that in the same post, two basic amount is fixed ??

Dear friend,

The Government has agreed stepping up of pay of senior direct recruited official with that of junior direct recruited official in the National Anomaly Committee Meeting. This has not been made applicable in cases of promotees with Direct recruited officials. Their issue that minimum pay in the cadre applicable for direct recruits be applied for promotes is still pending with the National Anomaly Committee.

The Sixth Central Pay Commission (SCPC) in its report recommended four distinct running pay bands. At the time of promotion from one post to the other, the grade pay attached to the posts in different levels within the same running pay band will change. Additionally, increase in the form of one increment will be given at the time of each promotion. Normal annual increments and variable increments to stimulate performance have also been recommended. Implicit on these recommendations is that the new entrants to service will be placed at the minimum of any one of the running pay bands corresponding to the grade pay attached to the post. In case of stagnation at the maximum of any pay band for more than one year, the employee will be placed in the immediate next higher pay band without any change in the grade pay. According to SCPC all the recommendations are to be treated as an organic whole as partial implementation will bring in several anomalies and inconsistencies.

The Resolution No. 1/1/2008-IC dated 29th August 2008 as also the O.M. No. 1/1/2008-IC dated 30th August 2008 issued in implementation of the recommendations of SCPC also contained nothing to suggest different minimum ‘entry pays’ in the running pay bands for different posts carrying different grade pays.

However, the CCS (Revised Pay) Rules, 2008 surprisingly incorporated a list of ‘entry pay’ for direct recruits appointed on or after 01.01.2006 vide Section II of Part-A under the First Schedule to the CCS (RP) Rules, 2008. This was not envisaged in the recommendations of SCPC and the prescription of entry pay in the pay band has made all the difference to constitute an anomaly.

During discussions at the anomaly committee meetings, the official side argued keeping in view the original recommendations of SCPC with reference to maintaining the sanctity of running pay bands but refused to take cognizance of the insertion of different ‘entry pay’ for direct recruits. With the introduction of different ‘entry pay’ for different grade pays, the very purpose of running pay bands stands defeated. Instead of prescribing the entry pay for each grade pay, the grade pays could have been inflated to make up for the requisite difference of pay between two grades.

Now, having given room for the anomaly, it is for the official side of NAC to understand the various problems posed to promotees vis-*-vis direct recruits in the matter of fixation of pay and suggest appropriate corrective action.

Dear Friend,

Why don’t you take advantage of the provisions of O.M. dated 5th July 2010 and exercise revised option to have your pay in the revised pay structure fixed from the date of upgradation i.e. 01.04.2006 instead of 01.01.2006. This way your pay on 01.04.2006 could be refixed to 13350 + 4800. Loss of arrears of pay for the 3 month period may not be significant.

You have stated that your basic pay was fixed as 12090+4600. I have not noticed this while posting my earlier reply. Your pay should be 12090+4800, since those joined in your department in the same scale in 9/2007 were given the grade pay of Rs.4800. Only thing is that the Direct Recruits after 1-1-2006 will get 13350 and others 12090 as pay in the band pay, which we expect to be settled through the National Anomaly Committee.

Dear sir,
Ministry of Railways already issued circular in this regard after consulting MOF.Letter no. is RBE NO. 28/2010 dated 17/02/2010.Para 5 of this circular permited stepping up for seniors eventhough they are promotees in par with junior direct recruited employee if both are borne on same seniority list.In short stepping up is possible only if one such junior who is borne on same seniority list is available.As you indicated,the demand of minimum pay applicable for the DRs be applied for promotees is not yet accepted.
