Iwas on CASUAL LEAVE on 01.07.2010 and consequently my annual increament has been disallowed on the said date instead I was allowed increament with effect from 02.07.2010. May any member clearly state the legal provision so that I can take up the matter with authority with proper legal backing quoting relevant legal provision.

Dear friend,

Increment can be postponed only when an official is on leave on 1-7-2010. As per CCS Leave Rules, Casual leave is not a recognised form of leave. Hence an official on Casual Leave is not treated as absent from duty. Hence you are eligible for increment with effect from 1-7-2010.

Casual leave is not recognise as a leave but concession(.) on casual leave one is paid duty pay where as during leave one is paid leave salary(.) as such a person on casual leave is considered to be on duty(.) hence eligible for benefit of increment(.) you may represent

I fully agree with Shri Pathakji Views on this matter. A person on CL on Ist July should get increment.

Please ask your officers to take action against the concerned officer. He is supposed to know the rule. If he does not know the Authority approving the said increment should have corrected it. This is a serious aspect. if you have done a mistake in your job if any loss of revenue happens, a vigilance file is opend against you. So please do not keep quite.:mad:

I fully agree with Sasi and RK Pathak. As CL is not a recognized form of leave under CCS(Leave) Rules 1972 and also as you are paid duty pay while on CL, you will be entitled to the annual increment w.e..f 1/7/2010.

Dear Sirs,
In the instant case, it shall be construed that the person handling the case does not know the rules governing grant of increment. As Mr. Pathakji stated, the when an official is not drawing any "leave salary", how this benefit is denied. Further, I would like to add that apart from CL, RH and compensatory holidays are not recognized holidays.

I feel these leaves should be treated similar to closed holidays.
