Sir

My friend resigned to take up another job higher post. he moved from govt to another govt office. He was asked to pay and allowances for the notice period. he had applied for the said post before joining. Please advise

The full details are as follows:

Mr. X joined an CAB and was on probation. As per the terms and conditions of his appointment he has to give one month notice before resignation during the probation. Before joining CAB he had applied for a post under UPSC. The same was not disclosed by him as he was not aware of the rule position. When he was on probation he got selected to that higher post under UPSC and resigned from the post in CAB. He was asked to pay the pay and allowance for the notice period. Whether he is exempted from such payment as he resigned to take up another post in Govt. Please quote the relevant rule also.

If the Central Autonomous Body (CAB) is following govt. rules then the resignation should be treated as a "Technical" Resignation. In such cases, notice period or pay and aloowances in lieu of, should not be insisted upon. However, your friend should have informed the CAB about his application submitted to UPSC. This needs to be condoned by the CAB by taking a lenient view.

It is was implied upon your friend having informed of his applying for any post before joing an organisation, which he di not. Uncder these circumstances he will trataed as having applied for without intimation. His resignation shall be treated as normal resignation and he has to give notice as is required under terems of his appointment or pay the salary for the lnotice period
