I am working in a PSU and my wife is working in a Central Govt. office. I am availing LTC facility from my office. Ours is a block year of two calender year (2004-2005, 2006-2007, 2008-2009 .....), which can be carried forward upto end of next block year and can be further extended due to official exigencies or personal reasons, with the approval of competent authority.

I have availed LTC for block year 2006-07 in April,2010 (with approval of c.a.) and my wife applied for EL Encashment at her office against this LTC. Her office is not approving EL encashment as the LTC availed is for prior block (2006-07). The circular for EL encashment was issued in 2008. Whereas GO dt 23.9.08 says ' EL can be encashed at the time of availing the LTC'

Kindly clarify the position.

Eearlier leave encashment upto 60 days were deducted from leave account and at the time retirement only leave encashment for 240 days was granted. W.e.f. 2008, such encashment is not deducted.

Kindly refer to clarification issued vide OM dated 24th November 2009 available at (http://persmin.gov.in/writedata/CircularNotification/ScanDocument/14028_2_2009-Estt.%28L%29.pdf).

As per this clarification Govt. employees are entitled to leave encashment while availing the LTC facility/privilege passes/concessional tickets of their spouses working in PSUs etc.

When the order mentions privilege passes, concessional tickets also, then obviously the schemes of the PSUs on one hand and the LTC scheme of the Govt. on the other hand may not match. Further, the order does not stipulate that the block years should match at all. In fact, in the case of privilege passes and concessional tickets there may not be any system of block years like govt has, but only a validity date by which the passes/tickets are required to be utilised. So the order dated 24.11.2009 has a wide scope and flexibility, and the spirit of the order is that govt servants will get the encashment.

The only condition that has been put is that the encashment will be limited to twice in a four years block of LTC and also fulfill Rule 38-A of CCS(Leave) Rules, which I think is fair enough. For e.g. a person in railways/airlines may get concessional tickets every year but the encashment to the spouse would be limited to only 2 occasions in a block of 4 years.

Sir,

Whether leave encashment days deducted from present leave account ?

Suppose i have now 150 E.L in hand, if i avail 10 days E.L and 10 days encashment, how many leave will remains ? 130 days or 140 days ?

Ofcourse 130 days shall remain to your cfredit.
