View Full Version : Appeal to NAC members with compiled anomaly points for discussion on 27th

All Official and Staff Side NAC members are solicited to remove the anomalies meted out to the Central Government Employees and to see that the existing orders are implemented in its true spirit. In spite of orders from Government in the CCS(RP)Rules, 2008, the following items are not implemented.

1. Granting of higher replacement scales.

The OM No.1/1/2008-IC dated 13th September, 2008 vide page No.4 under clarification 6 (i) states where all posts in one or more pre-revised scales are merged/upgraded with a higher pre-revised scale and given a common replacement scale/grade pay, that is to be given. In cases of merger and upgradation of posts of pre-revised pay scales, fixation of pay will be done as prescribed in Note 2A of Rule 7(1) in the manner indicated in illustration 4A and not as per fitment table of the existing scale.This is in order to protect the service of seniors with reference to juniors.

2. Bunching benefits.

The clause under Rule 7(1)(A)(ii) of CCS(RP)Rules2008 ie.,page 35 states for every two stages so bunched, benefit of additional one increment each will be added. But the same is not extended to all offices inspite of illustration 4A .

3. Parity between field office and Secretariat.

The pay commission vide report 3.1.14 (ie., parity between field offices and Secretariat ) and the same was accepted by government and issued orders vide item No. ii of Section 1 of Part B of the First Schedule of CCS(R.P)Rules, 2008 merging “three” scales ie., 5000-8000, 5500-9000 and 6500-10,5000 and upgrading to 7450-11,500, this has been extended only to certain grades of the pre-revised 5500-9000(as on 1.1.2006) working in the Secretariat which is against the decision of the government by interpreting the decisions of the government through a OM dated 16.11.2009 soon after the issue commom upgradation order available vide OM dated 13.11.2009. The R.T..I reply dated received vide U.O.No.22/01/2010-IC dated 25.1.2010 from S.D.Sharma under Secretary (IC-II) from the Ministry of Finance also states that the government already implemented the parity between field office and secretariat vide report 3.1.14. But this is not being implemented.

5. Discrimination of Group B Officers.

The Section Officers in the CSS also were drawing 6500-10,500 on 1.1.2006 at par with Field Group B Officers . When the Government upgraded the scale of Section Officers of CSS to 7500-12,000 in R.P.Rules, there was no mention for field officers. But one by one different Ministries started merging pre6500 and 7450 and upgraded to 7500 . So some of the field offices including the Section Officers/PS filed cases and the Principal bench vide OA.164/2009 ordered to give fixation in pre-7500-12,000 with GP4800 and NFS 5400. Accordingly they have claimed the arrears. So the pre-6500-10,500 in the field offices must also be given 7500-12,000 with fixation, bunching and stepping up provision.

6. Stepping up of Seniors.

The clause under Note-10 below Rule 7(1)(D) of CCS(RP)Rules2008 ie.,page 38 states stepping up should be given to the seniors with effect from the date of promotion of the junior Government servant subject to condition that both the junior and the senior government servants should belong to the same cadre and the posts in which they have been promoted should be identical in the same cadre. But the same has not been implemented through out the country

7. Treating of Common Categories.

As per report in para 3.8.1. the Common categories of staff are those categories that are engaged in similar functions spread across various Ministries/departments /organizations of the Central Government. These categories are not limited to any specific ministry of department and, therefore, any decision taken for them impacts more
than one Ministry/department/organization. But this has been extended only to few offices which is to be extended to all offices throughout the country.

8. Seniors are paid less than juniors by ignoring government decisions.

All scales in pre-revised scales be either replaced with higher replacement scale/upgraded scale or corresponding scale already granted w.e.f 1.1.2006 with proper fixations, bunching and stepping up as per rules. Otherwise the seniors will continue to draw less salary than the junior most in many department which is the first time in India and in the world.

In this context, it is also requested that necessary corrective measures may please be taken to remove the following Anomalies.

A. ACP and MACP.

Among the same post itself, there is a vast difference in the grade pay scale granted between ACP and MACP and lot of discrimination are occurred. When the scheme modified for giving of assurance for carrier, it should not be taking away the benefit already given to the same cadres. So it is requested to revive the ACP instead of MACP.

B. Uniform Multiplying factor.

At present different Multiplying factors are adopted at the rate of 1.86 for the scales of S-7 to S-23 (5th cpc) and all the remaining 5th cpc scales were granted factors ranging from 1.89 to 3.37 and the medium class officials are affected a lot which also needs immediate attention. It is suggested that a common multiplying factor be adopted for all. Otherwise the present position may please be raised to 2.62 at least upto PB-3

C. Common formula of increment for all.

The variable increment stipulated under Rule 9 be reviewed and extended 4% to all categories from PB-1 onwards without restricting to the 20% of the total strength.

D. Status of Clerical staff.(LDC/UDC/HEAD CLERK

The Pay Commission vide para 3.1.15 suggested separate recruitment to the Ministerial cadres in the field offices with a view to fill up all future recruitments in the pay scale of Rs.6500-10,500 corresponding to the revised pay band PB-2 along with grade pay of Rs.4200 for every field office and they be made as Executive Assistant . And for Direct recruitment, the commission suggested the candidates should possess minimum qualification of a Graduate degree and one year diploma in Computers.

The present posts in the field offices are Lower Division Clerk, Upper Division Clerk and Head Clerk. Most of them are Postgraduates with Diploma in computers/PGDCA. At present the LDC (pre-revised 3050-4590), UDC (pre-revised 4000-6000) and Head clerk (pre-4500-7000) and given Grade 1900, 2400 and 2800 respectively. The major work in the field offices are dealt by these categories. Whereas the pay commission has suggested Grade pay of RS.4200 for future Executive Assitants with lesser qualification (graduation +one year diploma only)

Further, the clerical staffs were demoralized by merging with the 4th standard/illiterates Group D employees in PB-1 without any suggestion from pay commission. Though the pay commission suggested only grade pay of 1300 alone to the Group D initially, the government raised the GP to 1800/1900. Whereas no increase has been made to the Clerical staff in the Grade pay and made in a very sorrowful condition by merging with these Postgraduated graduated clerical staff with illiterates/4th Standard people. It is imperative to reconsider their grade pay/designation keeping in view of their qualification/nature of work as under:

1. All the existing LDCs/UDCs/Head Clerks/Steno may be elevated to Executive Assistants with effect from 1.1.2006 as a one time measure in the field offices by restructuring the posts as directed by Ministry of Finance vie OM No.AB.14017/61/2008-Estt(RR) dated 24th March,2009 in a time bound way.

2.Till such time all the above three pre revised (3050, 4000, and 4500) be merged with a separate Pay Band (+PB-1) and grand them grade pay of Rs.2800 w.e.f. 1.1.2006

3. All the existing existing Group D be put together in a separate Pay Band (-PB-1) and continue to give them Grade pay of Rs.1800/1900.

E- Research Institutions in INDIA, (CSIR, ICMR, ICAR, DRDO and other S&T departments

Professors in the Scientifics institutions are treated at par with the teachers of the Diploma holders in Polytechnics this needs attention of the government. The following suggestions are made

1. The PB-3 after 3 years be placed in PB-4.

2. The 5th cpc pre-revised scale 12000-18000 be placed in PB-4 or reduce the starting scales from Rs. 37400 to 28000 keeping in view of the less multiplying factor(1.86) upto pre-revised S-3 scale.

3. The variable increment stipulated under Rule 9 be reviewed and extended 4% to all categories without restricting to 20% of the total strength.

4. The Research staff (Scientific and Technical) includes Group IV Qualifications like, Medical, Engineering, computer science, bio informatics; humanities (MBA), social- sciences, life science, basic sciences, and library science etc. were appointed on following grades.
A. RGP- 6600 for Jr. Scientist/Jr. Technical Officer, (PB-3)
B. RGP- 7600 for Sc. /TO, (PB-3)
C. RGP- 8900 for Sr. Sc. / TO,(PB-4)
D. RGP- 10,000 for Asst. Directors/principal scientist/TO (PB-4)
The Scientific Administrators/ Executive Scientist, should be placed in higher grades at par with GP12000 and HAG as they are responsible for high quality of innovations/research and guidance as eminent research scientists, at the level of Dy. Director and Directors of labs,

Our humble request to all members of the NAC is to give importance to the implementation of the orders already issued (ie., parity between Field office and Secretariat, stepping up of pay, bunching, even fixation with the minimum of higher replacement scale already approved in the pay Rules) and also to consider the other anomaly points stated above and for the act of which the entire Central Government Employees will be thankful to the members.

You have done a lot of home work and given excellent suggestions. Let us hope that this will reach to all CG employees and create a greater degree of awareness among employees.

Your effort in pooling in the views of many of us single handedly is commendable. Hope NAC members take note of it and do the needful.

Dear Mr. Krishnan,

It is really a commendable work. One simply thinks, had this much of insight into the affairs of pay and allowances of employees been there to the people who were deputed to make the recommendations. Your points are really relevant. One can simply wonder why the government is ignoring the existing anomalies and at the same time creating further anomalies by way of selective granting of perks to different sections of emnployees. It is a pity that even successive anomaly committee meetings also were attended by the members without the kind of home work that you are having. I am confident that your sincere efforts will give the required back up to the Anomaly Committee members when they meet again on 27th of this month.
