Pay-Scale: 12 000-375-16 500 Revised Pay Band: 15 000- 39 100 Grade pay 7 600 on 1.1.2006
Date of Promotion: 22.1.2009 in the pre revised scale18,400- 22,400 Revised pay band 37,400-67,000 with grade pay Rs. 10,000/-..
Pay before promotion: Rs.30,450/- wth grade pay 7600/-
Pay fixed on promotion: Rs. 37,400+ grade pay Rs.10,1000
Grievance: to be fixed at Rs 44,700 + grade pay Rs. 10,000/- equivalent to Rs 18,400 in pay band IV.

Administration on my promotion fixed my pay at the minimum of the pay band with grade pay 10,000 and next increment w.e.f 1st july 2010.
Within one month I had requested to fix my pay equivalent to Rs. 18,400 in the revised scale. The request was turned down on the plea that I had given option for revised pay with effect from 1.1.2006. Then again, I gave representation to fix my pay in revised scale with effect from date of promotion with new option.
Administration states that option given once can not be revised. I have written to Administration that option can be revised vide DOP&T’s OM No.16/8/2000-Estt.(Pay-1) dated 25.2.2003. Administration states that the option quoted above is available under the Fundamental Rules which have been superseded in terms of Rule 15of the CCS (RP) Rules, 2008. Hence, this option can not be exercised by him.
It may kindly be clarified whether I can revise my option to fix pay in revised scale with effect from the date of promotion which has taken place on 22.1.2009 in accordance with F.No.1/1/2008-IC dated 29th January,2009 which provides provision for revising vide above quoted letter No. dated 25.2.2003. I am ready to forgo Arrears which I have received. If I can, then I will give rejoinder. Please advise which may be beneficial to me

Dear friend,
Please read Clarification No. 2 of M.F., O.M. No. 1/1/2008-IC, dated 29.01.2009. You were entitled to elect to switch over to the revised pay structure from the date of your promotion i.e. from 22.01.2009 under Rule 5 of CCS (Revised Pay) Rules, 2008.
On your election to switch over to revised pay structure from January 2009, you will have to repay entire sum of arrears of pay and the excess pay drawn between September 2008 and January 2009.
Alternatively, if you continue with the option already exercised, you also stand a chance to stepping up of your pay in the pay band to 43000 as on 22.01.2009 corresponding to the Entry pay for the grade pay of 10000, once the enabling orders of Government on the recommendations of National Anomaly Committee is issued. In such an event, you need not have to forego the excess pay received between 01.01.2006 and 21.01.2009 on account of drawal of pay in the revised pay structure.

On 1.1.2006 my basic pay was Rs. 6900/- in pay scale 5500......I was promoted on 29.06.2007 in pay scale 6500......as per the 6th pay commission i was granted pay band 9300 with grade pay 4200.....now grade pay Rs. 4600 is granted to me.....so on 1.1.2010 what should be my basic pay?

Dear Shri Paragmandle,
In few CG offices (Secretariat as well as Subordinate Offices), GP 4800 is allowed for Rs.6500/- scale. Ofcourse, conditions like post (Gazetted or Non-gazetted), nature etc. applies. U may check up with your Estt.

Dear friend
As per FR 22 (I)(a)(ii), pay on promtion will be fixed at the same stage in promotional scale and if such stage is not there then at next stage in promotional scale. In second case date of incremant will also be changed. After sixth CPC, if promotion is given in a scale which does not involve higher responsibility, then there will be no fixation and difference of grade pay will only be added.

Iam working in a central autonomous institute.
I was working in 5000 basic and on 2002 nov i got assessment promotion to 5500 basic. On 2006 Jan my basic was 6550 and got fixed in 12190 basic with 4200 GP. on 2007 i got an assement promotion to 6500 basic and the new GP is 4600. is this pay is correct. please reply

You have not given the complete details. The grade pay of Rs.4600 granted to you is correct.
